Legal Nurse Consultant & Product Liability
Product liability cases result when a person is harmed by defect in a product, drug, or device and the person was not warned about the defect before he or she used it. Typically, these types of lawsuits involve manufacturers of medical products like breast implants, medical devices like heart valves, pharmaceutical drugs, and various types of equipment. Manufacturers can be sued by an individual or a group of people (class-action lawsuit or mass tort).
There are a lot of hazardous chemicals and substances in the world, and some of them have been used to create products for public consumption. A toxic tort is a case involving one or more persons who has been harmed by toxic substances such as radiation, asbestos, or exposure to pesticide. Typically these cases are filed by multiple claimants and often turn into a class-action lawsuit against the defendant.
